三、离婚
在美国，当事人双方婚姻关系的解除必须经过法庭判决。
1、管辖法院：
在美国，离婚诉讼应向夫妻一方所在地法院提起。而美国绝大多数州都规定，当事人必须在本州居住满一定期限后，才能具备在该州提起离婚的权利。不过，各州对于该居住期限的要求并不一致，短的
有6周时间，而长的也有6个月。
2、离婚程序：
在美国，离婚诉讼程序分为两种，即简易离婚程序(Summary Dissolution Procedure)和普通离婚程序(Regular Dissolution Procedure)o简易离婚程序虽然比较简捷方便，但各州却设定了一定的适用
条件，同时也对当事人的权利作了一定的限制性规定。
在离婚程序中，为协助当事人尽早达成一致协议，特别是关于子女监护与探视问题的解决，大多数州的法院还设置有调解程序。
为保护当事人的人身和财产安全，美国各州均设定有禁止令制度。当事人可在离婚诉讼过程中要求法院发布禁止令，如禁止原配偶骚扰、妨碍其生活，禁止任何一方在未经对方同意或法院允许的情况下
任意转移、抵押、或隐匿夫妻共同财产等。
