英国高院 首相无权启动退欧

Theresa May’s Brexit plans were thrown into turmoil yesterday after she suffered a High Court defeat that could trigger months of parliamentary warfare at Westminster over the terms of Britain’s departure from the EU.

特里萨.梅(Theresa May)的脱欧计划昨日陷入混乱局面。她在英国高等法院(High Court)遭到挫败,这可能在威斯敏斯特引发一场有关英国脱欧条件的、长达几个月的议会斗争。

Mrs May will today tell Jean-Claude Juncker, European Commission president, she is determined to face down a revolt by pro-EU MPs and stick to her plan to begin the Brexit process by the end of March 2017. “We have no intention of letting this derail our timetable,” her spokeswoman said.

The prime minister’s first line of defence is to go to the Supreme Court in early December to try to overturn a High Court ruling that she must grant a parliamentary vote before invoking Article 50, the EU treaty clause that triggers a two-year divorce process.

英国首相的第一道防线是在12月初向英国最高法院(Supreme Court)提起上诉,试图推翻高等法院有关她在触发《里斯本条约》第50条之前必须授权议会进行投票表决的裁决。第50条将开启为期两年的脱离欧盟进程。

If the appeal fails, Mrs May faces months of clashes in the House of Commons and the House of Lords. Dominic Grieve, a former attorney-general, said she could still hit her March deadline but it was not guaranteed.

MPs and peers are not expected to block Brexit altogether, but they will try to amend legislation authorising Article 50 to push the prime minister towards a “soft Brexit” negotiating stance. This would keep Britain in the single market and customs union.

Sterling jumped to $1.2448 after the ruling, with an intraday rise as high as 1.2 per cent. But the pound gave up some of its gains after the government said it would appeal.
